Survivorship Transfers in Ontario
When a joint property owner passes away, we can assist with transferring the property to the surviving joint owner(s).
When real estate is registered in the names of two or more owners as joint tenants with a right of survivorship, the deceased owner's interest may pass to the surviving joint owner(s) upon death. A survivorship application can then be registered with the Land Registry Office to update the property's title.
ELLO Law assists with the legal process, including preparing the necessary documentation and completing the registration of the Application for Survivorship.
A survivorship transfer may allow the property to be transferred without requiring the property itself to pass through the estate administration process. However, eligibility depends on how the property is registered and the circumstances surrounding the ownership.
Have you lost a spouse or joint property owner? Contact ELLO Law to discuss the transfer of the property and determine the steps required to complete the survivorship registration.
